1. Acceptance of Terms
By accessing or using the DocketRadar web platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you ("User") and DocketRadar ("Company," "we," "us," or "our").
By using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a law firm, company, or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2. Description of Service
DocketRadar is a web-based court monitoring platform that tracks court dockets across 20+ courts in 11 states. The Service provides automated change detection, email notifications for docket updates, a web dashboard for managing watched cases, optional practice management integrations (Clio, Google Calendar, Outlook Calendar), and data export capabilities.
DocketRadar performs court monitoring server-side on your behalf. Case data associated with your account is stored securely on DocketRadar servers and is accessible from your dashboard at portal.docketradar.com.
3. Free and Professional Tiers
Free Tier: The Free tier provides full monitoring functionality for up to 5 cases, including access to all supported courts, 15-minute auto-check intervals, email notifications, Clio integration, calendar sync, and data export. The Free tier is available at no cost and requires account registration with an email address.
Professional Tier: The Professional tier provides unlimited case monitoring with all features from the Free tier included. The Professional tier is offered at the pricing listed on our Pricing page. Professional subscriptions are billed monthly or annually and may be canceled at any time. Upon cancellation, your account reverts to the Free tier at the end of your current billing period. No refunds are issued for partial billing periods.
4. User Responsibilities
You agree to use the Service in compliance with all applicable laws, rules, and regulations, including the rules of professional conduct governing your legal practice. You are responsible for:
- Verifying the accuracy of all case information provided by the Service against official docket data
- Maintaining the security of your device and browser where DocketRadar data is stored
- Complying with the terms of use of the county clerk portal websites you access
- Safeguarding your Clio credentials if you choose to enable the Clio integration
- Not using the Service for any unlawful purpose or in any manner that could damage, disable, or impair the Service or court portal websites
5. Intellectual Property
All rights, title, and interest in the DocketRadar platform, website, branding, documentation, and associated intellectual property are owned by DocketRadar. These Terms do not grant you any rights to use DocketRadar's trademarks, logos, or brand assets without prior written consent.
You retain full ownership of your case data. DocketRadar claims no ownership or license over case information, work product, or any data you submit to the Service.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
DocketRadar does not warrant that the Service will be uninterrupted, error-free, or completely accurate. The Service relies on the availability and structure of third-party county clerk portal websites, which are outside our control. Changes to those websites may temporarily affect the Service's ability to detect docket updates.
DocketRadar is not a substitute for professional legal judgment. You are solely responsible for independently verifying all case information and meeting all filing deadlines, court dates, and professional obligations. Do not rely on DocketRadar as your sole source of docket monitoring for critical deadlines.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DOCKETRADAR, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
DOCKETRADAR'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO DOCKETRADAR IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.
8. Indemnification
You agree to indemnify, defend, and hold harmless DocketRadar, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees and costs) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any third-party rights.
9. Termination
You may terminate your use of the Service at any time by closing your DocketRadar account through the settings panel. If you have a Professional subscription, cancel it before closing your account to stop future charges, or contact us for assistance.
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your locally stored data remains on your machine — DocketRadar does not have the ability to access or delete data on your device.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in the State of Florida, and you consent to the personal jurisdiction of such courts.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the "Last updated" date at the top of this page and, when appropriate, by email to your registered account address. Your continued use of the Service after modifications constitutes your acceptance of the revised Terms.
12. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.
13. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and DocketRadar regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
